"content": "<p class=\"level1\">A notice is properly given under the <a href=\"term_rules\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_rules\">Rules</a> to a person if:</p> <div class=\"prov1\" id=\"clause_1.8.1.a\"><span class=\"label\">(a)</span>it is personally served;</div> <div class=\"prov1\" id=\"clause_1.8.1.b\"><span class=\"label\">(b)</span>a letter containing the notice is prepaid and posted to the person at an address (if any) supplied by the person to the sender for service of notices or, where the person is a <a href=\"term_registered_participant\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_registered_participant\">Registered Participant</a>, an address shown for that person in the register of <a href=\"term_registered_participants\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_registered_participants\">Registered Participants</a> maintained by <a href=\"term_aemo\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_aemo\">AEMO</a>;</div> <div class=\"prov1\" id=\"clause_1.8.1.c\"><span class=\"label\">(c)</span>it is sent to the person by facsimile or electronic mail to a number or reference which corresponds with the address referred to in <a href=\"#clause_1.8.1.b\" data-link-type=\"clause\" data-content=\"872811\">clause 1.8.1(b)</a>; or</div> <div class=\"prov1\" id=\"clause_1.8.1.d\"><span class=\"label\">(d)</span>the person receives the notice.</div>",

"content": "<p class=\"level1\">A notice is treated as being given to a person by the sender:</p> <div class=\"prov1\" id=\"clause_1.8.2.a\"><span class=\"label\">(a)</span>where sent by post in accordance with <a href=\"#clause_1.8.1.b\" data-link-type=\"clause\" data-content=\"872811\">clause 1.8.1(b)</a> to an address in the central business district of a capital city of Australia, on the second <a href=\"term_business_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_business_day\">business day</a> after the <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> on which it is posted;</div> <div class=\"prov1\" id=\"clause_1.8.2.b\"><span class=\"label\">(b)</span>where sent by post in accordance with <a href=\"#clause_1.8.1.b\" data-link-type=\"clause\" data-content=\"872811\">clause 1.8.1(b)</a> to any other address, on the third <a href=\"term_business_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_business_day\">business day</a> after the <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> on which it is posted;</div> <div class=\"prov1\" id=\"clause_1.8.2.c\"><span class=\"label\">(c)</span>where sent by facsimile in accordance with <a href=\"#clause_1.8.1.c\" data-link-type=\"clause\" data-content=\"872811\">clause 1.8.1(c)</a> and a complete and correct transmission report is received:</div> <div class=\"prov2\" id=\"clause_1.8.2.c.1\"><span class=\"label\">(1)</span>where the notice is of the type in relation to which the addressee is obliged under the <a href=\"term_rules\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_rules\">Rules</a> to monitor the receipt by facsimile outside of, as well as during, business hours, on the <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> of transmission; and</div> <div class=\"prov2\" id=\"clause_1.8.2.c.2\"><span class=\"label\">(2)</span>in all other cases, on the <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> of transmission if a <a href=\"term_business_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_business_day\">business day</a> or, if the transmission is on a <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> which is not a <a href=\"term_business_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_business_day\">business day</a> or is after 4.00 pm (addressee's time), at 9.00 am on the following <a href=\"term_business_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_business_day\">business day</a>;</div> <div class=\"prov1\" id=\"clause_1.8.2.d\"><span class=\"label\">(d)</span>where sent by electronic mail in accordance with <a href=\"#clause_1.8.1.c\" data-link-type=\"clause\" data-content=\"872811\">clause 1.8.1(c)</a>:</div> <div class=\"prov2\" id=\"clause_1.8.2.d.1\"><span class=\"label\">(1)</span>where the notice is of a type in relation to which the addressee is obliged under the <a href=\"term_rules\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_rules\">Rules</a> to monitor receipt by electronic mail outside of, as well as during, business hours, on the <a href=\"term_day\" class=\"term\" data-glossary-type=\"global\" data-link-type=\"glossary\" data-content=\"term_day\">day</a> when the notice is recorded as having been first received at the electronic mail destination;
